A jury trial has been scheduled for the case involving John Warren of Ouray, who is accused of sexually assaulting a woman who told police he assaulted her in December 2018 after serving her at his restaurant.
Warren, who owns Red Mountain Brewing Co., was charged with felony sexual assault in the case. His plea hearings were postponed three times last year, and his attorney asked for a jury trial at the latest hearing last week in Ouray County District Court.
According to Warren’s arrest affidavit, Ouray police investigated the report from the woman, who said she met Warren at the brewpub and initially agreed to participate in sex with him. But after initially consenting to sex, the woman told investigators Warren continued to make unwanted contact throughout the night and she did not consent to further sex. Police didn’t interview Warren about the allegations until nine months after the incident, according to the affidavit.
Judge Cory Jackson set an eight-day jury trial for Warren beginning May 10. It’s unclear whether that trial date may be postponed, as the COVID-19 pandemic has resulted in many jury trials being rescheduled.
Warren’s attorney, Gordon Gallagher of Grand Junction, told the court he anticipates bringing in various experts to testify in the trial. The prosecutor in the case indicated she has 14 witnesses at this time and may also call experts to testify.
