Q: Are utilities excluded?
A: If the question is referring to transformer boxes, the planning commission does not have jurisdiction over that.
Q: What is the definition of an accessory structure? Are all structures necessary to operate a mine accessory structures?
A: The definition is in section 22, not section 9, and has not changed. It includes all structures necessary to exercise a use by right, such as mining, including employee housing. (In section 9 currently and as proposed, agricultural and mining accessory structures are exempt from visual impact regulation as long as they are not on a ridgeline or escarpment.)
Q: Does contrasting color trim blend? (Blending is required in the proposed section 9 for structures that are subject to visual impact.)
A: Contrasting colors are not meant to blend. The planning commission proposes allowing contrasting trim color as long as it does not dominate the structure. The proposal does not list accepted colors.
Q: How does Marie Scott’s old house fit in the proposal? If a structure is historical, can it be painted white with a red roof?
A: The commission got help from Ouray County Historical Society and proposes to exempt from color requirements new structures consistent with existing structures built before 1920 and located within a mile. The applicant must provide data verifying historical accuracy.
Q: Has the planning commission reviewed recent problematic building permit applications and put them through the requirements of the proposal?
A by Williams: We tested various scenarios for two years, very thoroughly. I went through visual impact worksheets from 2009-2012. Every structure that passed under the old system passes under this system. The proposal is not more stringent. It focuses on mitigation techniques that are more effective.
A by Currin: I came up with the opposite result with the same data. I think it is more onerous.
A by Baskfield: We have gone through exhaustive data, and I thought the data was telling us something different from the majority of the planning commission.
Q: Are you concerned about lawsuits?
A by Parker: There is an axiom that no public hearing is complete without a litigation threat. We have been diligent in having the draft reviewed and were assured it is defensible. It doesn’t mean someone can’t sue. But one should not make decisions based on threats. We should do what is right.
A by Currin: Defensible just means the county can respond. There is no guarantee the county would win.
Q: Aren't there more compelling issues that need attention?
A by Williams: The BOCC directs us. We don't make up stuff to do. They revisited their resolution every six months. All land use resolutions since 2007 have included revising section 9.
A by Lipton: Section 9 is not a compelling issue, but it is a priority. Permits are compelling. This has been an ideal time to take on this complicated task because there have been fewer permit applications recently.
Q: How many people will the county have to hire to enforce this?
A: We have a fee structure based on land use staff cost estimates to conduct examinations, tests, etc. If the volume of building reaches the point that more people are needed, fees will provide for that.
