|Law suit against Ouray County dismissed|

Ouray County issued a press release Wednesday afternoon, stating the 10th Circuit Court of Appeals has affirmed the dismissal of a lawsuit filed in 2010 by a former county employee. The 10th Circuit ruled that the complaint filed by Norman Rooker for wrongful termination was properly dismissed by the federal district court. The Court of Appeals upheld the lower court's determination that the Ouray County personnel manual did not constitute an employment contract or contractual relationship and was clear in providing notice to employees that they are employed "at will." According to Ouray County Attorney Marti Whitmore, "It is a very well written and clear opinion. This is excellent news for the County. Litigation is always unfortunate, but this win supports the personnel policies and management of the County."
